While reports say the California Highway Patrol is investigating, I really think that would be a case of jurisdictional malfeasance - as it should be a federal matter, instead - that is, for the FAA to handle! 
Throw the book at him: No pilot's licence, failure to maintain proper altitude, not first receiving tower clearance before takeoff, violation of a no-fly zone, etc.
